These Terms of Use ("Terms") govern your use of the My Shift Tracker application and related services (the "App"), operated by George Kelly as a sole trader trading as My Shift Tracker. By creating an account or using the App, you agree to these Terms.

1. Use of the App

The App helps you record working hours, breaks, holidays, and estimated earnings for your own personal tracking. You may use the App only for lawful purposes and in line with these Terms.

2. Your Account

• You are responsible for keeping your login details secure.
• You agree to provide accurate information when setting up your account.
• You are responsible for activity under your account.

3. Your Content

You retain ownership of the shift data and settings you enter. You grant us permission to store, process, and display that data solely to operate the App for you.

4. Acceptable Use

You agree not to:

• Use the App to store false or misleading records for unlawful purposes.
• Attempt to access another user's data without authorisation.
• Interfere with or disrupt the App's servers or security.
• Reverse engineer, decompile, or redistribute the App.

5. Earnings Estimates

Earnings figures are estimates based on the rates and hours you enter. They are informational only and do not guarantee your pay. Always refer to your official payslip or employer for final figures.

6. Subscriptions and Payments

Some App features may require a paid subscription. Subscription price, billing period, and any applicable introductory offer are shown by Apple App Store or Google Play for your account and region before purchase. A subscription renews according to the terms shown at purchase unless cancelled through the relevant app store before renewal.

Apple and Google handle payment processing for purchases made through their stores. Subscription management, cancellation, and applicable refund processing are subject to the relevant store's systems and applicable law. Further information is provided in our Refund Policy.

7. Consumer Rights

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including applicable consumer rights relating to digital content and services. If any provision conflicts with a mandatory legal right, that legal right will apply.

8. Availability

We strive to keep the App available but do not guarantee uninterrupted access. Maintenance, updates, or factors outside our control may cause temporary downtime.

9. Termination

You may stop using the App and request deletion of your data at any time. We may suspend or terminate access if these Terms are breached.

10. Disclaimer and Liability

The App is provided "as is" without warranties of any kind. To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the App. Nothing in these Terms limits liability or rights that cannot lawfully be limited or excluded.

11. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Where required by law, material changes will be communicated appropriately.

12. Intellectual Property

The App, including its software, design, branding, text, graphics, and other materials, is owned by or licensed to My Shift Tracker and protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the App for personal use.

13. Governing Law and Jurisdiction

These Terms are governed by the law of Scotland. Subject to any mandatory consumer rights, the courts of Scotland will have jurisdiction over disputes arising from these Terms.
